Kristof Ongenaet wins award at BAT
Belgian player Kristof Ongenaet filed a claim against his former team S.S. Sutor Montegranaro (Italy) at the Basketball Arbitral Tribunal (BAT) for outstanding salaries, buyout payment, and interest. He played seven games for Montegranaro in the 2010-11 season. The player claimed that the club made only partial payments under an addendum and failed to pay the buyout payment in order to prematurely terminate his contract. The club did not file an answer, despite invitations by the BAT. The arbitrator of the case upheld the claim in its entirety.
The award states as follows:
1. S.S. Sutor Montegranaro srl must pay Mr. Kristof Ongeneat EUR 20,000.00 net as outstanding salary together with interest at 5% per annum from 3 June 2013.2. S.S. Sutor Montegranaro srl must pay Mr. Kristof Ongeneat EUR 25,000.00 as compensation together with interest at 5% per annum from 3 June 2013.3. S.S. Sutor Montegranaro srl must pay Mr. Kristof Ongeneat EUR 4,260.00 as reimbursement for his arbitration costs.4. S.S. Sutor Montegranaro srl must pay Mr. Kristof Ongeneat EUR 4,300.00 as a contribution to his legal fees and expenses.5. Any other or further-reaching requests for relief are dismissed.
