Krasnie Krilya sanctioned by FIBA
Russian basketball club Krasnie Krilya Samara was sanctioned by FIBA on December 2014 for its continued breach to honor an award granted by the Basketball Arbitral Tribunal (BAT) for two to of its former players, American DeJuan Collins (photo above) and American-Macedonian Jeremiah Massey. Both players filed a claim against Krasnie Krilya at the BAT for outstanding salaries, tax certificates, and interest. The Tribunal ruled in favor of the two claimants on October 2014. As a result of the continued breach, FIBA imposed a ban on the club on registering new players.
For reference, the abovementioned award reads as follows:
1. Basketball Club Krasnye Krylya Samara is ordered to pay Mr. Jeremiah Massey EUR 7,200.00 net in respect of unpaid salary, together with interest at 5% per annum from 7 April 2014.
2. Basketball Club Krasnye Krylya Samara is ordered to provide Mr. Jeremiah Massey with a tax certificate for all sums paid, including all sums paid pursuant to this Award.3. Basketball Club Krasnye Krylya Samara is ordered to pay Mr. DeJuan Collins USD 19,783.16 net in respect of unpaid salary, together with interest at 5% per annum from 7 April 2014.4. Basketball Club Krasnye Krylya Samara is ordered to provide Mr. DeJuan Collins with a tax certificate for all sums paid, including all sums paid pursuant to this Award.5. Basketball Club Krasnye Krylya Samara is ordered to pay jointly to Mr. Jeremiah Massey and Mr. DeJuan Collins EUR 5,000.00 as contribution to their legal fees and expenses.6. The costs of this arbitration until the present Award, which were determined by the President of the BAT to be in the amount of EUR 3,220.00, shall be borne by Basketball Club Krasnye Krylya Samara alone. Accordingly, Basketball Club Krasnye Krylya Samara club is ordered to pay jointly to Mr. Jeremiah Massey and Mr. DeJuan Collins EUR 3,320.00. The balance of the Advance on Costs, in the amount of EUR 1,680.00, will be reimbursed Arbitral Award 3/4 (BAT 0575/14) jointly to Mr. Jeremiah Massey and Mr. DeJuan Collins by the BAT.7. Any arbitration costs associated with a Request for Reasons shall be advanced and borne by the requesting party.8. Any other or further-reaching requests for relief are dismissed
