Bernard King vs. Krasny Oktyabr at BAT
Bernard King (196 cm, Texas A&M’03) filed a claim against former team, Krasny Oktyabr Volgograd (Russia-VTB) at the Basketball Arbitral Tribunal (BAT). The veteran American player submitted that the team did not make any payments and unlawfully terminated his contract. In its position, the club submitted that King’s claim was time-barred pursuant to Russian labor law. They also submitted that he committed disciplinary violations that entitled them to terminate his contract.
The BAT partially upheld the player’s claim with the Award stating the following:
1. Basketball Club Krasny Oktyabr Volograd is ordered to pay to Mr. Bernard King USD 69,075.00 net plus interest of 5% per annum from 18 December 2014.
2. Mr. Bernard King is ordered to pay EUR 2,000.00 to Basketball Club Krasny Oktyabr Volograd as reimbursement of the advance on arbitration costs.
3. Basketball Club Krasny Oktyabr Volograd is ordered to pay Mr. Bernard King EUR 4,000 as a contribution towards his legal fees and expenses.
4. Any other or further-reaching requests for relief are dismissed.
